The firm of Harrington and Harrington assists with federal registration of patents, trademark, trademarks, copyright, copy right, and copyrights.  We also handle limited tax matters and issues related to taxes.  We specialize in patent prosecution, which includes filing an application or applications (including a specification or specifications and a claim or claims) with the United States Patent and Trademark Office, or USPTO, or simply PTO.   The USPTO is a government office that generates office action or actions and corresponds with the attorney or attorneys (or lawyer or lawyers) who represent the applicant or inventor.  An agent or multiple agents may be involved in prosecuting an invention or inventions before the PTO.   Development of an invention is usually carried out by an entrepreneur or entrepreneurs who are seeking protection of intellectual property or properties.    Trade secret or secrets are also protectable.  A patent may cover design, utility, and plant or plants and may be accompanied by an information disclosure form or forms where applicable.  A company or companies may have one idea or many ideas regarding a software program or multiplicity of programs for use with a computer or several computers, in which case a patent filing or several filings may be warranted.   Patents may also cover a business method or methods.  Examination of the embodiment or several embodiments by the PTO may involve a search or many searches to determine the novelty of any step or steps or device or devices involved in the method or methods or process or processes.  A process claim may apply to a technique or techniques for producing or production of an article or articles.  Likewise, where a method of manufacture by a manufacturer or manufacturing company is involved, examination will also cover a machine or several machines or article or articles or composition.  Protection may also include protecting the technology with respect to engineering, chemical aspects, mechanical aspects, electrical aspects, biochemical aspects, medical aspects, biomed or biomedical aspects.  An inventor’s right or rights are based on the concept and may extend back to conception of the invention.   Industrial inventions and products of industry are also subject to patentability, and pending language may be used to indicate that a patent has been applied for.  A licensee may to license a product under a licensing agreement.   Where an applicant plans to apply for a provisional application, the risk to foreign patent rights should be kept in mind.  Once an examiner is assigned to examine an application, the application is forwarded to a tech or technical art unit.  The inventor who invents, seeks to invent, or has invented the invention and who will apply or has applied for a patent, i.e., the prospective patentee, may be able to take advantage of a capital gains deduction for gain on sale of the patent.  Likewise, fees paid to a patent attorney as well as an expense or expenses related to patent development may be deductible.  Chemical protection may apply to a system or systems or compilation or formula or formulae related to a chemical composition or compositions.  Joint venture or ventures should be approached with caution and only under a mutual written agreement in writing and signed by the parties.
